New York Passes Bill that Includes Prohibition on Geofences at Healthcare Facilities

Healthcare geofencing is an advertising tactic that enables companies, including law firms, to create a digital “fence” around a particular location and deliver location-based ads to healthcare providers or other individuals who enter the area based on their location data. Now New York has taken action to reign in geofencing.  Fiscal Bill A.3007C/S.4007 was signed into law in New York on May 3, 2023. The law prohibits the establishment of a geofence or similar virtual boundary around a healthcare facility (besides a person or company’s own healthcare facility) to deliver digital advertisements to a person in the healthcare facility. The law takes effect on July 2, 2023.
