New York Amends Law on Mandatory Overtime for Nurses

Since July 1, 2009, Section 167 of the New York Labor Law has restricted health care employers from requiring nurses to work more than their regularly scheduled hours except under four limited situations: federal health care disaster, declaration of emergency, an unforeseen emergency, or if the nurse is involved in a surgical or medical procedure that requires their presence for the health or safety of the patient. As of June 28, 2023, the amended law  also requires health care employers to report if they invoke one of the four exceptions to the mandatory overtime limits, and it establishes monetary penalties for violations.
