On January 12, 2023, a divided panel of the U.S. Court of Appeals for the Sixth Circuit upheld a lower court’s preliminary injunction staying the federal government’s government contractor Covid vaccine mandate. Similar to the approach taken by the 5th Circuit, the 6th Circuit limited the scope of the protection of the injunction to the plaintiffs, here the States of Kentucky, Ohio, and Tennessee. The 6th Circuit joins the 5th and 11th Circuits in ruling against the government contractor mandate, which the Safer Federal Workforce Task Force has put on hold with respect to all federal government contracts.
