A Florida appellate court recently affirmed sanctions imposed on a trial lawyer for making intentionally misleading and deceptive statements. According to the court’s Order, the attorney intentionally misrepresented the professional relationship and experiences with one of the physician witnesses. Further, the court found that the attorney intentionally violated rules of discovery when he sought the opposing party’s medical records from the opposing party’s medical provider by referring to a prior subpoena, which did not extend to the medical record. The court affirmed the sanctions imposed on the attorney, where the attorney will pay to the opposing party attorney and expert witness fees.
