CMS Announces Special Enrollment Period for Consumers Losing Medicaid or CHIP Following the End of the COVID-19 Public Health Emergency

On January 27, 2023, the Center for Consumer Information and Insurance Oversight (CCIIO) announced a Marketplace Special Enrollment Period (SEP) for consumers losing Medicaid or Children’s Health Insurance Program (CHIP) coverage as a result of the unwinding of the COVID-19 Public Health Emergency (PHE). The SEP will run from March 31, 2023 to July 31, 2024 and will allow eligible consumers to apply for coverage on the federally-facilitated Affordable Care Act Marketplace.  Consumers will be required to submit an application (or update an existing application) through HeathCare.gov and must confirm that their Medicaid or CHIP coverage has ended or will end during the SEP.  Consumers need not wait for their Medicaid or CHIP coverage to end prior to submitting a Marketplace application.  The goal of the SEP is to minimize the number of individuals that experience a gap in coverage due to the unwinding of the PHE. States that operate their own marketplaces may – but are not required to – offer the SEP.
