Last week, a Texas district court granted Kate Cox, a pregnant woman, a temporary restraining order against the state that would allow her to have an abortion due to a fatal fetal abnormality. The Texas Attorney General petitioned for immediate intervention to the Texas Supreme Court. On December 8, 2023, the Court temporarily blocked the ruling. On December 11, 2023, the Court issued a per curiam opinion reversing the lower court’s ruling, holding the doctor did not establish the plaintiff’s symptoms were life-threatening, which is required under Texas’s abortion law.
