As reported in an earlier edition of HLBytes, the Departments of Labor, Treasury, and HHS have proposed amendments to their regulations implementing the Mental Health Parity and Addiction Equity Act of 2008. On August 3, 2023, the Biden administration published the proposed rule in the Federal Register. Among other things, the amendments would require insurance companies and health plans to gather and use data to evaluate the impact of the non quantitative treatment limitation analyses requirements in the MHPAEA.
