Following the Deputy AG’s announcement on September 15 of the DOJ’s updated enforcement policies for corporate criminal enforcement, DOJ Principal Associate Deputy AG Marshall Miller provided more details on how DOJ plans to enhance corporate responsibility and individual accountability through changes to the policies on corporate cooperation and voluntary self-disclosure. In a keynote address to GIR (Global Investigations Review) Live: New York last week, Miller discussed an emphasis on corporate accountability and prompt cooperation, increased expectations for self-disclosure, support for companies with good compliance programs acquiring companies with misconduct history, and expectations that companies will have effective compensation clawback programs.
