On November 3, a New York attorney was suspended for failing to cooperate with an inquiry from the state attorney grievance committee. According to the court’s Order, the inquiry began because the grievance committee received a report of a dishonored check, which indicated the attorney’s escrow account was overdrawn. Although the attorney initially cooperated with the inquiry by submitting a preliminary audit of the escrow account, he failed to respond to subsequent requests for additional information. The court found that the attorney’s failure to cooperate constituted professional misconduct that immediately threatened the public interest, and pursuant to the Rule for Attorney Disciplinary Matters 22 NYCRR § 1240.9 (a)(1), (3), suspended the attorney until further court order.
