Florida-based Lee Health and Cape Coral Hospital used the HHS self disclosure program to report claims for pain management services that were submitted to federal insurers and that did not meet payment criteria. As a result, Lee Health and OIG settled the matter for $12.7M in repayment by Lee Health. In instances such as these, it is generally considered by attorneys and compliance officials alike that self-reporting is best, as having the federal government find overpayments in an audit could result in much steeper fines.
