Changes to the Independent Dispute Resolution Process Required by No Surprises Act

The Texas Medical Association had sued the Biden Administration over the way HHS implemented a portion of the No Surprises Act requiring independent dispute resolution entities to attempt to settle payment amounts. The Texas Medical Association claimed the process in HHS’s interim final rule “did not meet Congress’ vision for the bill.”  On February 23, a federal judge agreed.  HHS is currently working on changing itsguidance and will allow parties to reopen negotiations if they have already expired.
