On January 11, a California labor union filed a complaint with HHS OCR , alleging that DaVita, Fresenius Medical Care, and Satellite Healthcare are in violation of the Civil Rights Act and Affordable Care Act. The complaint asserts that nearly 1 in 5 dialysis treatments to Asian American patients and 1 in 7 treatments to Latino patients are rendered at speeds above 13 milliliters per hour, and that these patients are exposed to these dangerous high-speed treatments at a rate that is 50% higher than White patients. High ultrafiltration rates are associated with higher hospitalization and mortality rates, longer recovery, and serious symptoms, such as permanent heart damage and reduced cognitive function. The complaint requests OCR require the dialysis centers to cease rendering dialysis treatment at ultrafiltration rates over 10 milliliters per hour.
