CMS FAQs on the No Surprises Act “Good Faith Estimate” Requirement

The federal No Surprises Act, which became effective January 1, 2022, includes a good faith estimate (GFE) requirement that applies to all health care providers who schedule—at least three days in advance—the provision of items or services to uninsured or self-pay patients. The GFE requirement includes tight time deadlines and is not limited to providers who are caring for such patients out-of-network. No specialties are exempt. CMS recently issued FAQs explaining the GFE requirement.
