America’s Health Insurance Plans Files Amicus Brief in Favor of No Surprises Act

In January, AHIP filed an amicus brief supporting the federal government’s efforts to implement the No Surprises Act in a lawsuit (Association of Air Medical Services v. HHS) filed in the Federal District Court for the District of Columbia late last year. AHIP also filed an amicus brief in Texas Medical Association v. HHS, a separate lawsuit pending in Texas federal district court. AHIP addressed the importance and urgency of having the law’s requirements in place by January 1, 2022 to be of most help.

The AHIP brief in support of the DC lawsuit identifies circumstances unique to air ambulance services and how the Act will stabilize the market, ensuring that transportation is paid for fairly. AHIP also notes that centering IDR guidance on the “qualifying payment amount”fosters predictability and promotes fairness, both of which are critical to providing affordable access to quality coverage for all Americans. Following the filing, AHIP issued a press alert highlighting a number of points made in the brief.
