Federal Judge Voids CDC Mask Mandate on Planes, Trains, and Other Public Transport

On April 18, U.S. District Judge Kathryn Kimball Mizelle of the Middle District of Florida struck down a Biden Administration rule requiring travelers to wear face masks when traveling within or into the United States. Judge Mizelle ruled the order exceeded the CDC authority under the Public Health Services Act and violated the Administrative Procedure Act by excluding public participation in the notice and comment process. The rule applied to planes, trains, and other forms of public transportation, including ride-sharing vehicles, as well as transportation hubs, including ports, terminals, and subway and train stations.
