At least eight states may not take part in the proposed $26 billion opioids settlement against three major drug distributors and Johnson & Johnson. Some states, including Georgia, New Mexico, and Oklahoma,, believe that it is in their best interest to pursue their own claims against these drug makers. New Hampshire, another state not fully participating, will settle with the distributors while continuing its claims against Johnson & Johnson. The settlement formula was calculated envisioning forty-four (44) states, so the settlement amount is influenced by the number of participating states.
