The FTC voted to approve a series of resolutions authorizing compulsory process through civil investigative demands and subpoenas for testimony and documents, to investigate enforcement priorities in seven specific areas. The enforcement priorities include “repeat offenders; technology companies and digital platforms; and healthcare businesses such as pharmaceutical companies, pharmacy benefits managers, and hospitals.” The FTC has been active in investigating healthcare organizations and enforcing against unfair and deceptive practices. Recently, the FTC has reached a few settlement agreements with digital healthcare companies regarding the companies’ privacy and security practices, so the FTC will likely continue to scrutinize the healthcare industry.
