Higher Penalties Proposed for Hospital Non-Compliance with Federal Transparency Rule

Consistent with the recent Executive Order on competition, CMS issued a proposed rule, on July 19, that, among other things, would increase the penalty for some hospitals that do not comply with Hospital Price Transparency final rule that became effective January 1. The proposed rule sets a minimum civil monetary penalty of $300/day for smaller hospitals with a bed count of 30 or fewer, and$10/bed/day for hospitals with a bed count greater than 30, not to exceed a maximum daily dollar amount of $5,500.  CMS is allowing a 60 day period for public comment which runs from the date on which the proposed rule is published in the Federal Register.
