Oklahoma Supreme Court Invalidates Agency Medicaid Managed Care Plan

On June 1, the Oklahoma Supreme Court struck down the Oklahoma Health Care Authority’s Medicaid managed care plan because, among other things, the agency did not have legislative approval nor did it promulgate rules. The Oklahoma Legislature had since passed SB 131 authorizing Medicaid managed care in the state, which is discussed in the dissenting opinion. The ruling invalidated some $2 billion in contracts private companies signed with the Oklahoma Health Care Authority.
