Judge Polster Warns Pharmacies: Settlement May Save You

United States District Judge Dan Polster of the Northern District of Ohio, the judge overseeing the opioid MDL, warned pharmacies, including CVS Health Corp., Walgreens Boots Alliance, and Rite Aid Corp., that these companies may risk financial peril in not settling the thousands of government lawsuits. Judge Polster admonished the companies that if they ”want to hemorrhage money trying cases all over the country, they have a legal right to do it until they drop, go bankrupt or win them all. . .No other defendant is operating that way.” This statement comes as many other corporations are resolving claims through settlement, including a $26 billion accord with AmerisourceBergen Corp., Johnson & Johnson, Cardinal Health, and McKesson Corp.
