New York Mandates Health Insurers Cover Fertility Services for Those Unable to Conceive Due to Sexual Orientation or Gender Identity

On February 23, the New York State Department of Financial Services issued a guidance letter  requiring New York health insurers to cover fertility services for all New Yorkers regardless of sexual orientation or gender identity. Under this new guidance, health insurers are now required to provide immediate coverage of services for the diagnosis and treatment (e.g., intrauterine insemination procedures) of infertility for consumers covered under individual, small group, and large group health insurance policies who are unable to conceive due to their sexual orientation or gender identity.
