OCR Announces Fourteenth Settlement Related to the HIPAA Right of Access

On January 12, HHS OCR announced its fourteenth settlement  as part of the HIPAA Right of Access Initiative. As part of this initiative, OCR has made enforcement of an individuals’ rights to timely access to their health records at a reasonable cost under the HIPAA Privacy Rule a priority. In this case, the violations stemmed from two complaints against Banner Health related to delays in the receipt of medical records requested in December 2017 and September 2019. In each case, Banner Health took six months to provide the requested records. As part of this settlement, Banner Health agreed to enter into a settlement of $200,000 and a corrective action including two years of monitoring.
