Opioid Settlements: Attorney Fee Order Denied

U.S. District Judge Dan Polster denied a request for a levy against any future settlement in the opioid lawsuits to pay Plaintiff’s attorneys fees. In February 2020, Plaintiff’s attorneys submitted a request for a 7% fee assessment against any settlement, which could amount to almost $3.3 billion based on the proposed $48 billion settlement. Judge Polster denied the order, indicating that there is an expectation that “any eventual resolution of the lawsuits to include a method of paying the attorneys”, while leaving open the possibility to revisit the issue if circumstances change.
