Federal Court Blocks California from Requiring a Cancer Warning On Weed Killer Label

Earlier this week, a Federal appellate court blocked California from requiring Bayer AG (“Bayer”) to add a cancer warning to the label of their popular glyphosate-based weed killer, Roundup. The court reasoned that California's cancer warning requirement was not backed up by regulatory findings because numerous regulators have determined glyphosate is safe, even though the World Health Organization has determined that glyphosate is a "probable carcinogen." Bayer is currently facing lawsuits from more than 50,000 customers alleging Roundup causes cancer. Plaintiffs in the pending cases believe Bayer has manipulated studies to show the product is safe and three juries have ordered Bayer to pay large settlements, however Bayer is appealing the judgements, and insists glyphosate is safe for general use.
