Following the issuance of recommendations for the provision of elective procedures by CMS, more states continue to allow hospitals and ambulatory surgery centers to resume performing elective procedures. For example, Minnesota, Illinois, and Vermont, have issued orders that will begin to lift prohibitions on elective procedures that have been in place since March. These orders follow CMS guidance by setting forth specific criteria that must be met before a facility may perform elective procedures, including ensuring an adequate supply of protective equipment, as well as increased capacity if COVID-19 activity increases. The resumption of elective procedures provides much needed financial relief to facilities that rely on elective procedures for a significant part of their revenue, and allows facilities to provide necessary care to patients. However, facilities should comply with both the CMS guidance and any state restrictions prior to restarting elective cases.
