Massachusetts Lawmakers Debate COVID-19 Liability Legislation

Massachusetts is currently considering legislation that would provide a heightened level of legal protection for physicians, nurses, and other healthcare workers providing care to patients in response to the COVID 19 pandemic. The legislation would give medical professionals immunity from civil liability for any death or injury sustained as a direct result of an act or omission committed in the course of providing services in support of the State’s response to the COVID-19 outbreak, unless it was established that such death or injury was caused by gross negligence. Other states, including New York, have enacted similar legislation.
