CMS Issues Section 1135 Waivers To Combat Coronavirus Pandemic

On March 13, CMS announced steps designed to increase flexibility for providers and healthcare facilities in their fight against coronavirus. The HHS Secretary is now authorized to waive certain Medicare, Medicaid and Children’s Health Insurance Program (CHIP) requirements and conditions of participation under Section 1135 of the Social Security Act. Waivers issued to date include: (i) waivers for hospitals and other healthcare facilities; (ii) provider enrollment flexibilities; (iii) flexibility and relief for state Medicaid agencies; (iv) suspension of enforcement activities. Providers seeking provider-specific waivers or modification requests are encouraged to contact their CMS Regional Office.
