On January 17, the Supreme Court consolidated two Pennsylvania cases and granted certiorari in Little Sisters of the Poor v. Pennsylvania and Trump v. Pennsylvania. The question presented in these cases concerns the legality of the Administration’s expansion of conscience exemptions from the ACA’s contraceptive coverage mandate.
On January 21, the Supreme Court announced its decision to deny the motion of the petitioners supporting the ACA’s constitutionality for expedited review of their petitions for certiorari regarding the Fifth Circuit’s December 2019 decision in Texas v. U.S. A Supreme Court decision whether or not to review the Fifth Circuit decision is expected by the end of June 2020.
