Tennessee State Senator Sara Kyle ( D-Memphis) filed a bill that will “allow residents to petition the courts to temporarily remove firearms from relatives who pose a threat.” This is an example of a red flag law which has been introduced in response to increasing gun violence. Under the bill, a petitioner would have to file a sworn affidavit for an emergency protection order. If granted by a judge, the individual against whom the petition was filed would be prohibited from purchasing or even possessing a firearm during the term of the order. In order to receive an order, the Petitioner must prove that they are at an “immediate risk” from the individual and can face criminal charges if they are found to have lied or misrepresented their claim.
