In what is believed to be the first case of its kind, a woman in Jackson, KY pleaded guilty January 10 in United States District Court for the Eastern District of Kentucky to soliciting kickbacks from a toxicology laboratory in exchange for urine drug testing referrals. The Eliminating Kickbacks in Recovery Act (EKRA) was passed in October 2018 as part of legislation aimed at addressing the opioid crisis. The EKRA anti-kickback provisions have received attention because the prohibition applies regardless of whether public or private fund are used to pay for the services.
