CBD Companies Named in Class Action for Embellishing Product Use

On December 9, two class action lawsuits were filed in California alleging illegal marketing and sales of CBD products as dietary supplements, food additives, or medical cures for pets and humans. Plaintiffs filed the complaints against Infinite CBD and Charlotte’s Web Holdings, Inc. shortly after the FDA issued warning letters to several CBD companies. The FDA letters explained that the use of CBD detailed in the complaints was not approved by the FDA and violated the Federal Food, Drug, and Cosmetic Act. The complaints cited the FDA warning letters and seeks damages under California law, on behalf of nationwide classes and California statewide subclasses of CBD purchasers.
