Texas Judge Dismisses Claim for URC Care in Emergency Room

On October 28, the 160th Judicial District Court for Dallas County, Texas, dismissed an emergency care provider's claim for payment of usual, customary, and reasonable care under the Texas Emergency Care Statutes (Texas Insurance Code Sec. 1271.155, 1301.0053) and the Unfair Settlement Practices Act (Texas Insurance Code Sec. 541.060), finding those statutes do not confer a private right of action upon plaintiffs.  The Court also dismissed the provider's claims under the Texas Prompt Pay Statutes, for quantum meruit, and for declaratory relief.
