Sutter Health Settles Class Action, but not without Controversy

The judge in California’s antitrust suit against Sutter Health system has delayed trial due to the problems encountered in sitting and keeping jurors. The litigation is an antitrust claim against Sutter prompted by payors’ complaints over the contract negotiation tactics used by Sutter. The suit alleges that the contract negotiation tactics force the payors to pay abnormally high rates for many locations to keep Sutter in network. Given the size of the system, the complexity of the legal and factual issues, and the length of the anticipated trial, the court is having difficulty sitting a jury.
