Senate Majority Leader Mitch McConnell has proposed language that would require the FDA to issue enforcement discretion guidance related to the sale of products containing CBD. The 2018 Farm Bill legalized the cultivation and sale of hemp at the federal level, effective January 1, 2019, but the FDA currently forbids the sale of food products or dietary supplements containing CBD in interstate commerce. The proposed language would require the FDA to issue its formal enforcement discretion policy on hemp CBD within 120 days.
