CVS and Sentry Data Systems Settle Ongoing Antitrust Battle

On September 12, 2019, Sentry Data Systems and CVS Pharmacy announced they have reached a settlement in Sentry Data Systems, Inc. v CVS Health et. al. The agreement will settle Sentry's claims that CVS violated antitrust law by tying CVS’s 340B contract pharmacies to CVS's own 340B Program compliance software, Wellpartner, a direct competitor of Sentry. Sentry had alleged that CVS developed Wellpartner using proprietary information obtained during a prior partnership. CVS had countered that Sentry's software failed to meet contractual specifications, requiring CVS to develop its own software. Details of the settlement are not final, but the court has issued a stay of the proceeding for 45 days pending final settlement.
