Federal Prosecutors Use Longstanding Law as New Tool in AKS Enforcement

In April 2019, the District Court  for the Northern District of Texas found seven people guilty in a $200 million bribery scheme at Forest Park Medical Center, which was intended to induce doctors to direct patients with private insurance that had higher reimbursement rates to Forest Park. In exchange, kickbacks were paid and disguised as consulting or marketing fees.  As part of its legal strategy, prosecutors used the 60-year old Travel Act to implicate the individuals, which was discussed in a recent edition of the ABA Health eSource
