AARP Files Class Action Lawsuit Against Yale University Alleging GINA Violations

The AARP Foundation filed a class action lawsuit against Yale University alleging that its employee wellness program violates the Genetic Information Nondiscrimination Act (GINA) and ADA. According to the AARP, Yale requires its employees and their spouses to either submit to medical exams and disclose personal health and genetic information or pay $1,300 fine annually. The AARP alleges that disclosing medical and genetic information in workplace wellness programs must be voluntary as required by federal law. However, according to the AARP, this wellness program is not voluntary because employees must either disclose their health information or pay a fine.
