The DOL issued a statement disagreeing with the decision in State of New York v. United States Department of Labor which vacated DOL’s previously published final rule, and DOL has filed a notice of appeal in the case. In the meantime, employers who joined association health plans can continue to offer this coverage through the end of the current plan year. DOL will not pursue claims against those who acted before the court’s decision in reliance on the proposed rule.
