VA Governor Vetoes Bill Regulating High-Risk Artificial Intelligence

On March 24, 2025, Virginia Governor Glenn Youngkin vetoed House Bill 2094, the High Risk Artificial Intelligence Developer and Deployer Act. The Governor’s veto letter cited the bill's "burdensome artificial intelligence regulatory framework" as a threat to the state's continued economic growth and asserted that existing state laws adequately protect consumers.

The bill aimed to mitigate AI-driven algorithmic discrimination in areas of consequential decision-making such as  healthcare, employment, financial services, housing, parole, and education. It would have required developers and deployers of “high-risk” AI to protect against algorithmic discrimination and implement risk management policies and programs. 

While HB 2094 received bipartisan support, the bill narrowly passed Virginia's House and Senate in February 2025 and would require a two-thirds majority in both chambers of Virginia’s General Assembly to override Governor Youngkin’s veto.
