HHS Directs OPTN to Expand HIV Organ Transplantation Beyond Current Allowances Under HOPE Act

In a Final Rule published in the Federal Register on November 27, 2024, HHS directed the Organ Procurement and Transplantation Network (OPTN) to develop and implement new standards with respect to kidneys and livers from donors with HIV to ensure that kidney and liver transplants carried out under the HIV Organ Policy Equity (HOPE) Act are subject to OPTN policies that are consistent with the National Organ Transplant Act (NOTA). Pursuant to this Final Rule, OPTN announced on January 10, 2025, that it plans to update these standards on an expedited basis to comply with HHS’s directive. Until such new requirements are developed and implemented which are consistent with HHS’s directive, the current requirements will remain in effect.
