In 2010, the DOJ brought a lawsuit against the state of Georgia challenging the state’s unnecessary segregation of individuals with mental illness and developmental disabilities into institutions; however, the state has allegedly continued these practices. Despite federal oversight, Georgian patients continue to have to fight for the rights guaranteed under the ADA to receive care in a community setting, or at home, if they so choose. State officials previously agreed to reduce the number of mentally ill and disabled patients being unnecessarily placed in institutions; however, it is still a work in progress.
