CMS Proposes Rule to Update OIG’s Exclusion Regulations, Including Exclusions Based on Default of Health Education Loan or Scholarship Obligations

On December 2, 2024, HHS published a proposed rule to revise OIG’s exclusion regulations based on an individual’s default on a health education loan or scholarship obligation. Among other things, the proposed rule aims to codify OIG’s longstanding practice of permitting an individual’s exclusion to be “stayed” as long as the individual enters into and complies with a repayment agreement with the administrator of the health education loan, scholarship, or loan repayment program after a payment default. The comment period for the proposed rule ends on January 31, 2025.
