California Expands Civil Discovery Exemptions for Review Committee Materials

Governor Gavin Newsom recently approved AB 2225, amending Section 1157 of the California Evidence Code to expand the information exempt from civil discovery to include proceedings and records of prehospital emergency medical person or personnel review committees. Section 1157 previously exempted the proceedings and records of specified peer-review and quality of care committees as evidence. With this expansion, prehospital emergency medical care physicians will now join the wide range of medical professionals who can invoke Section 1157 in civil proceedings where discovery is governed by California law.
