The Citizens for Responsibility and Ethics in Washington (CREW) has issued a letter stating that, in boycotting hiring from Stanford, Yale, and Columbia law schools upon ideological grounds, citing an article on Judge James C. Ho’s refusal to hire law clerks from Yale Law School, certain federal judges are violating Code of Conduct for United States Judges Canon 3B3, which states that law clerks should be hired only based on merit, and Canon 2B, which mandates that a judge should not allow political relationships to influence his or her judicial conduct. On May 6, 2024, thirteen Trump-appointed judges noted their objections to Columbia’s handling of protests over violence in Gaza, linking the demonstrations to “antisemitism and hatred for diverse viewpoints” in announcing their decision to no longer hire law clerks from Columbia University or Columbia Law School.
