Texas Medical Board Struggles to Clarify Exceptions to State Abortion Law With New Proposed Rule

On May 20, 2024, the Texas Medical Board held a public meeting on its Proposed Rule regarding the circumstances under which an abortion is permitted under Texas law to save a patient’s life or major bodily function. Organizations including the Texas Medical Association and the Texas Hospital Association expressed concern that the Board’s proposed guidance imposes overly onerous documentation requirements and may not be sufficiently clear for physicians. The Board will weigh public feedback before its June meeting, at which point it will either elect to put the proposed guidance to a vote or revise and restart the public comment process.
