To Hear or Not to Hear: Reasoning of Judges Regarding the Hearing of the Child in International Child Abduction Proceedings

This Article brings a large sample of empirical data gathered from 938 national cases and 62 transnational cases to the debate over why judges may refuse to hear a child in return proceedings and whether the results are consistent with States’ legal obligations.
