Medical Monitoring Progresses in Vermont: An Update on Toxic Tort Cases and Legislation

In the legal field of toxic torts, substantial uncertainty lingers around the availability of medical monitoring as an injunctive remedy for certain tortious conduct. Victims and defendants alike seek answers as to whether a plaintiff may hold a defendant accountable for the costs of medical monitoring for future health issues caused by the defendant’s tortious pollution of natural resources with hazardous “forever chemicals.” In Vermont, this uncertainty may soon be lifted.
