Like a comet that appears in the night sky once every four years, the public’s interest in the Congressional Review Act (CRA), 5 U.S.C. §§ 801–08, seems to wax and wane between presidential election cycles. The 2020 election is no different, bringing renewed attention to how this legislative tool could be used by a potential Biden administration to overturn Trump administration rules.
