Determined to synchronize its fee collection efforts with the start of the federal fiscal year, and to begin offsetting the costs of implementing the 2016 amendments to the Toxic Substances Control Act (TSCA), the US Environmental Protection Agency (EPA) released its final TSCA Fees Rule on October 17, 2018. 83 Fed. Reg. 52,694. The rule spells out the various “user fees” that manufacturers and, to a lesser extent, processors of chemical substances must submit to EPA in the context of various TSCA regulatory activities. The final rule was effective on October 18, 2018.
