Natural Resources & Environment (NR&E) is the premier publication and member benefit of the ABA Section of Environment, Energy, and Resources. Published quarterly, by season, each issue includes nine to ten feature articles reflecting the issue's given theme. Calls for Article Proposals are announced approximately eight months in advance of the publication date.

Call for Article Proposals: Revival and Innovations of the Common Law (Winter 2022)

The ABA Section of Environment, Energy, and Resources’ magazine Natural Resources & Environment will devote its Winter 2022 (36:2) issue to articles on Revival and Innovations of the Common Law.

NR&E editors seek articles that explore the resurgence and innovation of the common law to address new and dynamic questions of liability and property rights in the environmental, energy, and natural resources domains. Whether as a substitute for or complement of statutory and regulatory regimes, novel theories of common law liability and property rights have been advanced on many fronts, and old common law theories have been resurrected to fill gaps. NR&E editors are interested in proposals that trace and evaluate these developments or propose new applications or innovations of common law doctrine. In selecting authors, strong preference will be given to Section members. 

Suggested topics for the “Revival and Innovations of the Common Law" (Winter 2022) issue include, but are not limited to:

Liability theories | Public Trust Doctrine | Public Nuisance | Pore Space/Carbon Sequestration | Trespase | Preemption/Displacement | Qui Tam | Negligence in Climate Change Era | Duty to Warn | Failure to Act | Water Pollution Nuisance | Force Majeure | Water Rights |Toxic Torts | Air Rights | Wind Rights |Solar Rights | Judicial Takings | Tribal Lands | Social Justice | Natural Resource Damage Claims | Federal Common Law

We are currently soliciting authors to contribute articles to this issue.

Authors should submit a proposal, including full contact information and their professional employment, position, or affiliation. Upon completion, be sure to click on the “submit” button at the bottom right on the form. Submitted forms are transmitted directly to the Issue Editors (below). The editors seek articles covering a diverse range of topics written by a diverse range of authors. In selecting authors, strong preference will be given to Section members.

Article proposals are due by April 16, 2021.

Article selections will be made and authors will be notified by April 23. Article outlines are due by May 21, 2021, and initial article drafts are due by June 20, 2021. Authors will work with an editor from the NR&E Board throughout the publication process and will be assigned a specific word count limit. The word limit assigned to NR&E articles is typically 3,500 words. Articles should be written in magazine style (citations in text; no footnotes). NR&E article guidelines can be found here.
